Hutchings Traductions General Conditions

 

1. Any order implies the customer's complete and unreserved acceptance of these general conditions of sale and the renunciation of clauses in their own general conditions of purchase which are contrary to them.

2. Quotations, Orders and Estimates

a. All quotations made remain in force for a period of 14 days; after that period they may be subject to a revision. The estimated time for completion of a translation or other project is given in good faith but as an indication only of the probable time required for the work. Such an estimation starts from the working day after the reception of the documents to be translated or treated.

b. If after placing an order for a translation or other project the customer cancels his order, the total amount of the order will nevertheless be invoiced to the customer.

c. A customer placing an order for a translation or other project is considered to have the right to do so. HUTCHINGS cannot be held responsible for non respect of copyright or other rights of third parties.

d. Quotations of price are based on pre-viewing of the whole of the original document before supplying a quotation. Work done after an estimate (without viewing the complete document) will be invoiced according to the number of words, standard lines, or pages in the original text, or by the hour as agreed with the customer.

3. Responsibility - Ownership

a. No liability is assumed by HUTCHINGS for any error or event beyond our control or for any consequential damages of any kind. Any and all liability shall be confined to correcting errors in translated texts. No liability is accepted for any consequential damages.

b. In the absence of a signed written order, HUTCHINGS cannot be held responsible for any errors of interpretation resulting from a lack of written information from the customer.

c. The property of the translated works or projects and all rights pertaining to these works or projects remain the property of HUTCHINGS until such time as full payment has been received including any interest due on the payment. Until full payment has been made for a translation or other project it cannot be used, or reproduced without specific permission.

4. Claims

Any claim concerning a translation or project should be addressed to HUTCHINGS by registered letter within seven days of reception of the work. The absence of any complaint by registered letter within seven days indicates the unconditional acceptance of the delivered translation or project.

5. Conditions of Payment

All bills and invoices are payable on presentation unless expressly agreed in writing by HUTCHINGS. Payment will follow immediately on receipt of each bill or invoice, in cash (€ only by registered mail), by French cheque in euros, international money order, bank wire transfer or other means as required on our estimate, quotation or acceptance for the work. As demanded by French law, all payments not received by the date fixed will be charged interest equal to one and a half times the French legal interest rate.
